The United States Sentencing Commission recently released the latest statistics on federal drug charges and new trends are emerging. According to their data, federal drug charges are being prosecuted less, but this doesn’t mean those who are accused of drug-related crimes are home-free.

The latest statistics indicate that a major contributing factor in the decrease in overall cases is the legalization of marijuana in select states. The federal government has agreed to take a hands-off approach in this regard, which has resulted in a decrease of approximately 2,000 cases per year. In 2011 and 2012, there were more than 6,000 marijuana trafficking cases prosecuted by the feds, but a sharp decline that began in 2013 now brings the total to fewer than 4,000 cases annually.
Although federal drug charges are down, most states are prosecuting more, especially where marijuana is concerned. Texas is no different, and has one of the highest marijuana arrest states in the entire country. At last count, 97-percent of the charges related to marijuana possession.
At the same time, federal drug charges have increased for other types of trafficking. Methamphetamine prosecutions have grown by about 2,000 cases per year in the same time span, Heroin has risen by around 1,000, and Oxycodone, though minor in comparison, has also been rising steadily over the years.

The United States Sentencing Commission’s report also indicated that the Western District of Texas had the highest drug trafficking rates of any area in America. Overall, methamphetamines account for 31.5-percent of cases, with powder cocaine coming in at 20.5-percent, and marijuana at 17.1-percent.
Sentencing lengths for federal drug crimes remain high as well. Those arrested for meth trafficking received an average of 85 months in prison. Crack charges resulted in an average of 79 months, powder cocaine at 72 months, Heroin at 65 months, OxyContin at 46 months, and marijuana at 29 months.
